Audiobook Payment Terms and Conditions

PLEASE READ THESE TERMS CAREFULLY AND IN FULL. THEY CONTAIN IMPORTANT CONDITIONS AND RESTRICTIONS ON THE AVAILABILITY OF AUDIOBOOK CONTENT (DEFINED BELOW).

Please read these Audiobook Payment Terms and Conditions (these "Audiobook Terms") carefully as they govern your use of (which includes Access to) audiobooks or other audio versions of literary works of authorship, such as books, comics, newspapers, magazines, and other audio versions of literary works of authorship, which you pay to access on an individual basis ("Audiobook Content"), on the Spotify Service (as that term is defined in the Spotify Terms of Use, which are hereby incorporated by reference). Once you have made a one-time payment for access to Audiobook Content you will have Access to the applicable Audiobook Content. Audiobook Content governed by these Audiobook Terms does not include any audiobook or other listening hours included as part of a Paid Subscription (where available) or a free-of-charge or other promotional membership or plan on Spotify, which are instead governed by the Spotify Terms of Use. Capitalized terms used but not defined herein shall have the same meaning given to them in the Spotify Terms of Use. For the avoidance of doubt, the Audiobook Content is deemed "Content," for the purpose of applying the Spotify Terms of Use to these Audiobook Terms. In the event of a conflict between these Audiobook Terms and the Spotify Terms of Use, the Audiobook Terms shall govern.

By paying to Access or otherwise use Audiobook Content on the Spotify Service, you agree to these Audiobook Terms and the Spotify Terms of Use. If you do not agree to these Audiobook Terms and the Spotify Terms of Use, then you must not use the Spotify Service or access any Audiobook Content.

1. Audiobook Content

(a) Availability of Audiobook Content

(i) You acknowledge that certain Audiobook Content may not be available to you for legitimate reasons, including but not limited to the following: based on your location and jurisdiction; if you do not meet applicable age requirements; due to relevant laws, regulatory requirements and rightsholder licenses; if we need to make modifications, improvements or updates to the Audiobook Content; or if we determine that you are in breach of these Audiobook Terms, the Spotify Terms of Use or any other applicable policies.

(b) Use of Audiobook Content

(i) You must have a Spotify account to use all or part of the Spotify Service. From time to time, you may be required to update the Spotify Service or the operating system on your Device to access the Audiobook Content. Failure to do so may mean that the Audiobook Content is not available to you. For more information about updating the Spotify Service or the operating system on your Device, please refer to this support article.

(ii) Unless otherwise provided, the Audiobook Content is compatible and/or interoperable with the third party applications and devices listed in this support article.

(iii) You may only Access the Audiobook Content through the Spotify Service or a Third-Party Application or Device, and you need an active account to the Spotify Service to do so. If you'd like to listen to the Audiobook Content on a particular Third-Party Application or Device, please check compatibility with the Spotify Service before making a payment.

(iv) Subject to these Audiobook Terms, when you pay for or are otherwise granted Access to Audiobook Content, Spotify grants you a revocable, limited, non-exclusive right to Access the Audiobook Content solely for your personal, non-commercial use for as long as you have an account to the Spotify Service. No ownership or permanent access rights in the Audiobook Content are transferred or granted to you. You acknowledge that Access to the Audiobook Content can be revoked by Spotify in accordance with the terms of Section 1(c) of these Audiobook Terms.

(v) You acknowledge that we are granting you the right to Access the Audiobook Content, subject to Section 1(a), and that such Audiobook Content is not sold or transferred to you and that Spotify and/or its licensors retain ownership of the Audiobook Content even after you pay for or otherwise access the Audiobook Content.

(c) Access Revocation

(i) We reserve the right to revoke your right to Access the Audiobook Content, permanently or temporarily, for legitimate reasons, including but not limited to the following reasons: (A) a valid legal claim or order; (B) if the Audiobook Content violates applicable law, regulatory requirements, our terms or policies, the proprietary rights of any third party, or if the proprietary rights of any such third party is withdrawn by the rightsholder; (C) your violation of these Audiobook Terms, the Spotify Terms of Use, or any other applicable terms or policies; (D) if we suspend or terminate all or the relevant part of the Spotify Service or otherwise make changes to the Spotify Service pursuant to Section 2 of the Spotify Terms of Use; or (E) your payment for the Audiobook Content is not successful.

(ii) If we exercise our right to revoke your right to Access the Audiobook Content pursuant to these Audiobook Terms, the Audiobook Content may no longer be available to you through the Spotify Service. In such cases, we will provide you with a refund where we are legally obliged to do so. We may also provide you with a refund pursuant to Section 2(c) below.

2. Purchases and Returns

(a) Discounts

(i) Spotify may offer discounts or promotions with respect to the Audiobook Content. Such discount or promotion may not be retroactively applicable to your previous payment or download. We may also make Audiobook Content that you have already paid for available for free in the future, without, subject to applicable law, any liability to you.

(b) Refunds and Withdrawal Right

(i) In certain cases, we may offer refunds for Audiobook Content that you have already paid to Access. In such cases, you may request a refund by contacting Customer Support. The applicable refund policy for each work of Audiobook Content will be specified on our Customer Support page when you pay to Access that Audiobook Content. You acknowledge that a refund may not be available in all cases and that we may change our refund policy at any time. Our refund policy does not limit your statutory rights to claim a refund under any applicable law.

(ii) All refunds will be credited to the original form of payment.

(iii) Unless otherwise required by law, we reserve the right to monitor refund requests for any abuse, such as excessive requests, frequent requests for refunds of Audiobook Content after substantial listening, or multiple successive refund requests. In instances where we find refund privileges are being misused, we reserve the right, where permitted under applicable law, to limit the number of refunds you may request or that we honour, including, but not limited to, the loss of refund privileges.

(iv) In countries where legally required (including but not limited to the EU/EEA and UK):

(1) When you pay for Audiobook Content, you expressly:

(A) consent to us providing you with the Audiobook Content immediately following your payment; and

(B) acknowledge that you lose your statutory right of withdrawal when the provision of the Audiobook Content begins (i.e. once you have clicked 'Buy' or 'Purchase now' or equivalent) and you authorize us to charge you for the purchase at the same time.

(c) Taxes

(i) Spotify may charge taxes on any payment of Audiobook Content. Tax rates are calculated based on the information you provide and the rates applicable at the time you are charged. These amounts can change over time with local tax requirements in your country, state, territory, county, or city.

  1. EU/EEA customers only – Guarantee of conformity

Under European Union law, you benefit from a legal warranty that the Audiobook Content will conform to these Audiobook Terms throughout the period of time during which Access to the Audiobook Content is to be provided to you under these Audiobook Terms.

For customers in Denmark: The remedies for non-conformity under the Danish Sale of Goods Act (Købelovens mangelsregler) apply.

  1. Non-EU/EEA customers – Guarantee of conformity

If the laws in your country of residence require it, the Audiobook Content will conform to these Audiobook Terms during the time you access the Audiobook Content under these Audiobook Terms. You may also have additional legal rights if the Audiobook Content is defective or does not conform to these Audiobook Terms. Nothing in these Audiobook Terms affects those rights.
